NSW:Standen's co-conspirator already jailed

SYDNEY, Aug 11 AAP - One of the men involved in a drug importation plot with former
NSW crime investigator Mark Standen has already admitted the crime and been jailed.

Sydney foodstuffs businessman Bakhos "Bill" Jalalaty, 48, was jailed last December
for a minimum of six years and a maximum of 10 years by Justice Bruce James.

The NSW Supreme Court jury at Standen's trial was not told of his guilty plea.

But after the former NSW Crime Commission investigator was convicted of three offences
on Thursday, the judge lifted suppression orders relating to Jalalaty.

In May last year, he pleaded guilty to conspiring with Standen and others, between
early 2006 and June 2008, to import 300 kilograms of pseudoephedrine, used to make the
drugs speed and ice.

Standen was convicted of a similar offence which also named as a conspirator drug trafficker-turned-informant
James Kinch.

The 54-year-old was also found guilty of taking part in the supply of 300kg of the
substance and guilty of conspiring to pervert the course of justice.

When sentencing Jalalaty, the judge said his role was to develop his legitimate food
importing and distribution business so that a shipment of rice, with pseudoephedrine concealed
in it, would be less likely to attract attention.

"Standen had the important role of corruptly advising the other conspirators and corruptly
using resources available to him with the NSW Crime Commission and with other agencies
such as customs, to further the carrying out of the criminal enterprise," he said

He accepted that Jalalaty was naive and inexperienced in the importation of illicit
drugs and that he was to some extent taken advantage of by the other conspirators.

Jalalaty "believed he would make millions of dollars as his share of the profits of
the criminal enterprise", the judge found.

He received a 40 per cent discount for his guilty plea and assistance.

He will be eligible for release on parole in June 2014, taking account of time served
since he first went into custody.

CANBERRA, Feb 20 AAP - Coalition MPs pushing for tax cuts and extra spending in this
year's budget have been bolstered by comments made by Reserve Bank governor Ian Macfarlane.

Mr Macfarlane told a parliamentary committee on Friday the federal surplus was sufficiently
strong to sustain a tax cut this year.

The market has speculated the government could post a whopping budget surplus of about
A$17 billion, up from a forecast of A$11.5 billion.

BRISBANE, April 15 AAP - The head of the inquiry into Queensland's floods has described
a crucial part of the operations manual for Brisbane's Wivenhoe Dam as a "mess".

The Queensland Floods Commission of Inquiry on Friday heard from a third engineer,
Terry Malone, who directed releases from the dam in January's floods.

Engineers have told the inquiry how they used models that didn't factor in forecast
rain when moving to operating phase W4, which allowed them to make large releases from
the dam in order to save it from collapse, even if that meant flooding properties.

More than 14,000 Brisbane homes were flooded on January 13.

On Friday, Mr Malone was questioned over the manual, and how engineers took into account
models with and without forecast rain, as well as the height of the Wivenhoe Dam lake,
when making their decisions.

Commissioner Justice Catherine Holmes said that part of the manual was a mess.

"This really is a bit of a mess, isn't it?" she said.

Mr Malone replied: "It's a very difficult concept, yeah."

Justice Holmes disagreed.

"It's not the concept, there are three different ways in which it's expressed in the
manual," she said.

The inquiry in Brisbane continues.

MELBOURNE, Dec 28 AAP - Police have not ruled out foul play in the death of a man whose
body was discovered in a house in Melbourne's northeast.

The body was found by a family friend about 11.30am (AEDT) on Tuesday at the single-storey
brick house in Doncaster Rd, Donvale.

Detective Senior Sergeant Shane O'Connell from the Homicide Squad told reporters the
death was, at this stage, being treated as suspicious.

It was not known how long the body had been there or the cause of death.

He said the body was yet to be formally identified and police were in the process of
notifying the man's family.

"We've had a number of witnesses that have come forward to assist us and they're currently
with us and assisting with our investigation," he said.

It is believed to be the man's house.

Forensic detectives were at the house, which had been cordoned off.

BRISBANE, Aug 18 AAP - While the major political parties dicker over paid parental
leave, thousands of employees of Australian corporations are already at home feeding,
changing and bathing the baby.

A survey by HR consulting firm Hewitt Associates has found 71 per cent of Australian
corporate organisations are already offering some form of paid parental leave.

Labor has legislated a scheme to begin on January 1, offering new parents earning up
to $150,000 18 weeks' leave on the minimum wage, currently $570 a week.

The coalition has promised primary carers 26 weeks paid parental leave, at full replacement
pay to a maximum of $150,000 or the federal minimum wage, whichever is greater. It would
be funded through a 1.5 per cent levy on big business, but would not be introduced until
July 2012.

According to the Hewitt Paid Parental Leave Pulse Survey conducted in July and August,
most companies recognise the long-term value of offering paid parental leave to support
and retain loyal employees, as well as attract them back to work after leave.

However, some are not yet sure how to address the issue and are waiting for the election
outcome before they commit to paid parental leave.

"Our research has found that on the whole, corporate Australia leads the way in recognising
the role paid parental leave plays in maintaining an experienced and loyal workforce,"

said Tim Powell, Hewitt Associates managing director for Australia and New Zealand.

"However, with different timeframes being thrown around by the coalition, Labor and
the Greens, some organisations are unsure of what is best practice and how to implement
it."

The survey found that 36 per cent of companies with paid parental leave are fairly
generous with their commitment, offering the primary carer 12 or more weeks of paid leave
at full pay.

"The argument around paid parental leave is often that the cost is too high for business
to bear, but the reality is it is an investment that saves organisations money in the
long-term," Mr Powell said.

"The cost to replace an experienced staff member can be up to 75 per cent of their
annual salary, when you take into account the cost of recruiting a new employee and the
time it takes for them to become a productive contributor to the business."

It's not just primary carers who receive benefits from employers.

According to Hewitt's survey, more than half of Australian corporates also offer paid
parental leave to secondary carers - with one in three providing at least one week's pay.

"Irrespective of federal policies and politics, the majority of Australian corporates
are already offering paid parental leave, seeing it as a competitive advantage to attract
and retain talent in an increasingly tight labour market," Mr Powell said.

CANBERRA, April 9 AAP - The industrial umpire has slammed the Commonwealth Bank for
giving employees a pay rise without consulting their union.

The bank has now been ordered to give the Finance Sector Union (FSU) details of its
budget for the next two years, and negotiate with its adversary.

In mid-2009, the FSU sought a 4 per cent annual pay rise for bank tellers and call
centre workers.

But the bank told the union it wasn't in a position to negotiate, before giving the
workers on a collective agreement a much smaller 1.5 per cent pay increase.

Fair Work Australia has criticised the bank for refusing to negotiate with workers
on a collective agreement as it held talks with more senior staff on individual contracts.

"Its conduct in having two different positions on wages: one for its employees in the
collective bargaining forum and one for its employees directly, is unfair conduct which
undermines collective bargaining," commissioner Greg Smith said in his judgement.

The bank had also failed to disclose relevant information to them, he found.

The tribunal has ordered the Commonwealth Bank to provide a negotiating position on
pay to the FSU within seven days.

The bank has also been ordered to give documentation to the union and Fair Work Australia
outlining its projected employee budget for 2010 and 2011.

FSU national secretary Leon Carter said the tribunal's decision would make the bank's
37,000 workers distrustful of its employer.

"This decision has revealed the ruse and, sadly, will only serve to heighten employee
scepticism about the bank's genuineness," he said in a statement.

In July 2009, the bank gave a 1.5 per cent base salary rise to employees earning less
than $100,000 a year, and another 2 per cent remuneration rise in January 2010 to staff
whose performance met expectations.

Both increases were awarded without the involvement of the union, which took the bank
to Fair Work Australia in early 2010.

The bank told the tribunal the global financial crisis was behind its reluctance to
initially agree to a pay offer unless certain hurdles were met.

But the industrial umpire said the bank needed to be clearer "in relation to the GFC".

NSW: Our history through the eyes of Thomas Keneally

SYDNEY, Aug 27 AAP - The history of Thomas Keneally is vividly documented at his home
on Sydney's northern beaches which he shares with Judy, his wife of 45 years.

In the modest, light-filled apartment indigenous art works adorn the walls along with
framed letters and greeting cards.

One, signed by film director Steven Spielberg, thanks Keneally for his work for the
Jewish community.

Another wishes the couple a happy festive season - it's signed Bill and Hillary Clinton.

A grandfather clock stands in a corner. Family photos, including one of Keneally's
four grandchildren, grace a cabinet.

One bookcase is filled entirely with books written by Keneally, the only exception
a copy of Ulysses by James Joyce.

The famous author is on the phone in his office. Eventually, a small round man wearing
track suit pants and a rather grubby jumper emerges.

He greets me and runs his hand over his chin.

"Should I shave?" he asks.

"No, just wash your face," his wife suggests.

Keneally is one of Australia's best known and most successful authors. He published
his first book in 1964 after leaving a Sydney seminary where he was studying for the priesthood.

Since then he's written more than 40 books including The Chant of Jimmie Blacksmith
and Schindler's Ark, which won the 1982 Booker prize and was adapted as Spielberg's Oscar-award
winning 1993 film called Schindler's List.

Just over a month shy of his 74th birthday, he has two new books out.

The first, published this month, is The People's Train, about Russians who escaped
Tsarist Russia and lived in Brisbane before returning home for the Revolution.

The second is the first volume of an ambitious three-volume history of Australia titled
Australians: Origins to Eureka, which was launched by Prime Minister Kevin Rudd at Parliament
House on Thursday.

A specialist in historical novels, Keneally says he is fascinated by the "universality
of human experience when you encounter it in the past".

He admits he wore the hats of novelist and historian when writing Origins. It's put
together with a historian's eye for facts and a novelist's eye for character and personal
journeys.

"What I've done, or tried to do, is deal with Australians who are obscure but whose
lives illustrate a major aspect of Australian history," he says.

"I've tried to choose either Australians that an intelligent general reader has never
heard of, or show aspects of famous Australians' lives which we don't know about.

"Anyone who's wearing a funny naval hat and a funny naval costume and britches and
poncey stockings, I've tried to look at the man beyond that."

Keneally, the Sydney-born descendant of Irish immigrants, says one aspect of Australian
history that fascinates him is that not only were convicts sent to Australia, but also
"economic refugees and the unsatisfactory children of the gentry".

"Being sort of working class trailer trash myself I love to celebrate rather than decry
the fact that Australia has been used as a dumping ground for so long," he says.

"Australia's Adam and Eve didn't begin pure and then fall from grace - they were already
condemned when they arrived here ... so there's a certain perversity in this book."

In terms of perversity, he describes his own life as "a bit like Australian history",
including his decision to turn his back on a life in the priesthood.

"I learnt a lot about good and evil in (the seminary) and the cosmic struggle between
good and evil.

"On the other hand I learnt a lot about legalism instead of broadness of spirit.

"It was more important to go to mass and communion than to be a sinful rescuer like
Oskar Schindler (the subject of Schindler's Ark)."

He was also disillusioned with the response of the Church to child abuse accusations,
saying it went for lawyers before compassion.

He hints at something else that might have been at play, saying "sexuality is always
a great underground river in people's lives, particularly seminarians' lives, and it almost
certainly had something to do with my leaving."

His decision to quit before being ordained gave the literary world Thomas Keneally,
but it also had other benefits.

"After I left I started trying to meet girls," he says.

"One of the reasons I wrote my (first) novel ... was so that I could sashay into bars
and instead of telling girls that I was a ruined monk - not a good pickup line - I could
say `I'm a novelist'.

"I felt when I had my first book published I felt I was back to being a member of society."

As for the future, the staunch republican and former chairman of the Australian Republican
Movement predicts Australia will continue to "grope towards" both a republic and reconciliation.

And he doesn't discount a future penal colony in space.

"Ask yourself what would happen if you put 15,000 guards and prisoners in space orbit,
which we will one day," he says.

Keneally - a self-confessed rugby league tragic and Manly's number one ticket-holder
- is also a Living National Treasure.

Apart from some sniping that he was a Nazi apologist for writing Schindler's Ark, it's
hard to find a bad word about him.

He is however, prepared to confess to some vices.

"One is impetuosity, which is both a strength and a weakness," he says.

"I rush into things far too quickly including the subjects of novels. For example when
I was .. asked me write this (history), I almost immediately said yes.

"I didn't immediately think, `come on Tom, you're over 70. What if you don't get to volume 3?"

And while he says he's generally patient, he is more than capable of "doing his lolly".

"I'm very patient according to everyone, but when I do my lolly I do it too much, and
then I apologise too much.

"I apologise until instead of my wanting to hit a bloke he wants to hit me.

"I only learnt late in life that the way to survive is instead of wishing that things
were different, to accept them as they are, instead of wishing that everyone agreed with
you.

"And why should they? Because I'm only a silly old bugger."

Vic: Girl suffers serious bites after dog attack

An eight-year-old girl will require surgery to her legs after being attacked by a Rottweiler
this afternoon in Victoria.

It's believed the girl was with her father at a family friend's property at Snake Valley
.. near Ballarat .. when the attack happened.

Ambulance Victoria spokeswoman GABRIELLE DEGENHARDT says the girl has deep penetrating
bites to her legs and lacerations to her hands.

She's in a stable condition in the Ballarat Base Hospital.

It is not clear at this stage who owns the dog.

NSW: One dead, two injured after pedestrian incident

SYDNEY, Aug 9 AAP - A teenager is dead and two others injured after being hit by a
ute on the NSW far south coast.

The 17-year-old boy and five friends had been walking along Southhead Road at Moruya
about 7.15pm (AEST) yesterday on the way to a party, police say.

"At about 300 metres west of the Congo Road, a Toyota HiLux struck the young man and
injured two of his friends," police said is a statement.

The 17-year-old is believed to have been killed instantly.

The other victims - girls aged 15 and 16 - were taken to Moruya Hospital with minor injuries.

The 17-year-old youth driving the HiLux is helping police with their investigations
into the incident.

CANBERRA, Feb 15 AAP - Questacon has come a long way from a modest science centre set
up in a Canberra primary school in 1980 and run by volunteers.

The national science and technology centre plays host to thousands of school children
every week and has earned an international reputation for its interactive science exhibitions.

Questacon staff reflected on the centre's history today as they marked the 20th anniversary
of the opening of a purpose-built centre.

More than six years in the making, the $20 million centre was co-funded by the Japanese
government.

Since the opening more than 6.8 million visitors have walked through the doors of Questacon
and a further 14.9 million have participated in its travelling exhibitions around the
country.

Questacon exhibitions have also visited 31 other countries.

Director Graham Durant said the key to the centre's success was its hands-on approach to science.

"The hands-on-exhibits and the face-to-face demonstrations are the key," Professor Durant said.

Questacon will mark the anniversary with an exchange student program with Japan and
a number of new exhibitions including one on measurement and phenomena.

Engineer GRD Ltd post $6.9 mln H1 profit

SYDNEY, Aug 28 AAP - Engineering and waste disposal group GRD Ltd has posted a half
yearly net profit of $6.9 million, a significant improvement on the $579,000 loss for
the corresponding period last year.

GRD Ltd also reported a revenue increase of 38 per cent to $134.64 million for the
six months to June 30.

GRD said the significant increase in profit came from "the financial close of its Lancashire
Waste Project (in the UK), an improved contribution from GRD Minproc and lower corporate
and unallocated costs".

"Establishing the Lancashire Waste Project, in partnership with Bovis Lend Lease Ltd,
was a significant achievement and milestone for Global Renewables (GRD), being the culmination
of several years of development and providing a strong platform to secure further waste
projects of this sort in the UK," the company said.

"The profit before tax to the consolidated GRD group from the financial close of the
Lancashire Waste Project was $9.019 million."

Labor says a Federal Court decision against workers at a Sydney car parts manufacturer
is disappointing .. but not unexpected.

Opposition industrial relations spokeswoman JUILA GILLARD says under the government's
new IR laws .. workers have nowhere to go when they are being treated unfairly.

The Federal Court's ruled yesterday New South Wales's industrial watchdog has no power
to hear the case involving employees of Tristar.

They say the company's trying to dodge redundancy payouts to 26 of its workers .. at
its factory in Marrickville .. in Sydney's inner-west.

Employees claim there's no work to do .. but the company is paying them to turn up
until the expiry of a redundancy agreement early next year .. which promises four weeks'
pay for each year of service.

The workers .. many of whom are aged in their 50s and 60s .. each have an average of
30 years' service with the company.

Nationals senator BARNABY JOYCE .. says he's encouraged by reports senior government
ministers are trying to fast-track Australia's biodiesel industry.

Senator JOYCE has constantly pushed the importance of biodiesel or biofuels industry
.. to help bring down the price of petrol.

He wants mandated levels of ethanol in petrol .. a move opposed by Prime Minister JOHN HOWARD.

The Australian newspaper says senior ministers met yesterday and decided to make ethanol-blended
fuel more widely available.





Ethanol is extracted from sugar cane and blended with petrol.

The resulting fuel is up to 4 cents cheaper .. because of a government subsidy which
is being phased out.

GOLD COAST, Qld, Feb 15 AAP - A man who twice threatened to shoot down a helicopter
with a homemade bazooka and tomatoes fired from a spud gun has been sentenced to two years
probation.

Anthony Douglas Donohue, 35, today pleaded guilty in Southport Magistrates Court to
two counts of threatening to endanger the safety of an aircraft.

"You have to admit it was pretty stupid behaviour," Magistrate Alex Chilcott told Donohue
after handing down the sentence.

The court was told Donohue, of Sorrento, was annoyed by a helicopter on survey flights
near the home he shares with his parents.

It was alleged he made threats to Air Services Australia on November 22 last year after
lodging complaints about the helicopter with police and Coolangatta Airport.

"I have a homemade bazooka and if that helicopter is here again tomorrow I will fire
the bazooka at this guy," Donohue was alleged to have said.

"I have had a gutful."

Donohue also claimed he was "going to shoot tomatoes out of his spud gun" to bring it down".

The pilot returned to base because of the threats.

The prosecution sought a $5,000 fine, arguing such threats should be taken seriously
following a world-wide spate of terrorist attacks.

Donohue's solicitor Bill Potts said his client was under stress over a relationship
breakdown and his failure to find work in the building industry following a holiday in
the United States.

Mr Potts also said Donohue had been suffering from post-traumatic stress after being
assaulted in a home invasion last year.

The noise from the helicopter was "the straw that snapped the camel's back" for Donohue,
Mr Potts said.

"My client did not even have a bazooka or a spud gun that could shoot tomatoes so clearly
he made a threat he couldn't carry out," Mr Potts said.

"It was a spur of the moment act of stupidity in circumstances where he was clearly distressed."

Mr Chilcott ordered Donohue to undergo psychiatric counselling as part of his probation orders.

Schering-Plough Submits NDA for Temodal(R) as Treatment for Brain Tumors, Malignant Melanoma

MADISON, N.J., Aug. 18 /PRNewswire/ -- Schering-Plough Corporation (NYSE: SGP) today announced that it has submitted a New Drug Application (NDA) to the U.S. Food and Drug Administration seeking marketing clearance for TEMODAL(R) (temozolomide) Capsules for the treatment of adult patients with malignant glioma (glioblastoma multiforme and anaplastic astrocytoma) at first relapse and as first-line treatment for patients with advanced metastatic malignant melanoma. The company has requested priority review status for the NDA.

TEMODAL, an oral cytotoxic, alkylating agent, is the lead compound in a new class of compounds known as imidazotetrazines. Schering-Plough has exclusive worldwide rights to market temozolomide through a licensing agreement with Cancer Research Campaign Technology, Ltd., of the United Kingdom.

Schering-Plough in January submitted a centralized Marketing Authorization Application for TEMODAL to the European Union's (EU) European Medicines Evaluation Agency (EMEA) seeking marketing clearance for the treatment of patients with recurrent malignant gliomas. EMEA approval of the centralized Marketing Authorization for TEMODAL would result in unified labeling that would be valid in all 15 EU-member states.

Malignant gliomas, such as glioblastoma multiforme and anaplastic astrocytoma, are among the most serious and aggressive types of malignant brain tumors, with median patient survival times ranging from nine to 12 months from initial diagnosis. Despite intensive treatment with surgery, radiotherapy and chemotherapy, patients with malignant glioma almost invariably experience tumor recurrence. Median survival in patients with recurrent high-grade glioma ranges from only three to six months from the time of recurrence.

Glioblastoma multiforme is a rapidly growing cancer of the central nervous system, most often located in the cerebrum. It is the most common and deadliest type of primary brain tumor. Anaplastic astrocytoma is the second most common type of brain tumor.

Malignant melanoma is the most serious and life-threatening form of skin cancer, accounting for only about 5 percent of skin cancers but causing approximately 75 to 85 percent of skin-cancer-related deaths. Patients with Stage IV (disseminated malignant) melanoma generally have a very poor prognosis. Median survival for Stage IV patients ranges from four to eight months, with five-year survival being rare.

WASHINGTON: Contrary to popular fears that cultivating Facebook friends will harm people's ability to make friends offline, research suggests that users of social networking sites have higher measures of social well-being.

According to results of a Pew Research Centre survey released on Thursday, Facebook users are more trusting, have more close friends, and are politically-engaged.

"There has been a great deal of speculation about the impact of social networking site use on people's social lives, and much of it has centred on the possibility that these sites are hurting users' relationships and pushing them away from participating in the world," lead author of the report Keith Hampton said.

More close relationships

"We've found the exact opposite - that people who use sites like Facebook actually have more close relationships and are more likely to be involved in civic and political activities."

Last fall, researchers surveyed 2,255 adults about their use of social networks such as Facebook, MySpace, LinkedIn, and Twitter. The research indicates a sea change in social relations. Forty seven per cent of adults use social networking sites, up from 26 per cent in 2008, when a similar survey was conducted.

Facebook users who sign in to the site several times a day are 43 per cent more likely than other Internet users and more than three times more likely than non-Internet users to feel that most other people can be trusted. Frequent Facebook users were particularly active during the US midterm election season.

They were two and half times more likely to attend a political rally or meeting and 43 per cent more likely to have said they would vote, the report said.

ATF National Tracing Center Chief Charles Houser and the NTC team was named one of 34 finalists for the Samuel J. Heyman Service to America Medal winners at the Partnership for Public Service breakfast on Capitol Hill May 5. The finalists were honored during the May 1-7 Public Service Recognition Week by the Partnership for Public Service in celebrating excellence in our federal civil service.

Houser and the NTC team were picked as one of four finalists for the Justice and Law Enforcement Medal category. Houser was nominated for leading an expert team that traces recovered firearms to help law enforcement authorities solve violent crime.

The nomination citation states, The NTC is the country's only facility that tracks firearms from a manufacturer to a purchaser. The center aids law enforcement in identifying suspects involved in criminal violations, detects firearms trafficking, and tracks the intrastate, interstate and international movement of crime guns.

Ditech Networks, a provider of voice quality solutions to the world's communications industry, announced that Bandwidth.com, a business communications provider, has purchased and installed Ditech's Packet Voice Processor (PVP) solution to support Web 2.0 and VoIP applications. Tyco Telecommunications (US) Inc. lands Antilles Crossing cable system.(SUBMARINE)

Tyco Telecommunications announced the completion of both the St. Lucia and Barbados landings of the Antilles Crossing Cable System. Antilles Crossing is a 940km state-of the-art undersea fiber-optic cable system linking St. Lucia, Barbados, and St. Croix. Antilles Crossing will provide reliable, high-speed communications to the rest of the world. The bandwidth available on the Antilles Crossing Cable system is scalable to meet the region's evolving telecommunications and Internet needs, both for today and for many years to come. Undersea cable systems aggregate data from various communication mediums (fixed-line, microwave, cell-phone, and even satellite) and transport it on today's information superhighways. Mortgages with Mom and Dad; Is it smart to borrow from a family member? Often, yes; sometimes, no.(HOMES)

With a 6 3/4 percent interest rate on his 30-year mortgage, Mitchell Weers of Rosemount thought he had a pretty decent rate. Then out of the blue, his father-in-law offered to better that bank rate by refinancing the mortgage with his own money at 4 percent. "That's the cheapest I'm ever going to get," said Weers, who now makes monthly mortgage payments to his in-laws rather than the bank. "I feel sort of like I'm producing income for him, so what the heck, I have to pay it anyway. Why not pay a family member so he can earn money on that?"

Welcome to the Mom and Dad Bank, an institution that's been around for as long as there have been mortgages, kneeling pads and double-digit interest rates. But with home prices rising and downsized baby boomers looking for ways of investing profits from the sale of the big family house, loans between family members are becoming more common. Still, mixing family and money can bring its own problems, experts warn. How do you pester a kid who doesn't pay on time? Does taking Dad's money give him more say over other parts of your life? And what about the kid who apparently can't make a payment but has plenty of money to eat out and take vacations?

Asheesh Advani runs a company called CircleLending that facilitates such arrangements. He said that the number of intra-family loans he's facilitated has increased 25 percent per quarter for the past 12 quarters and that his clients aren't just the filthy rich, old-money, Country Club set that you might expect. A growing number are the "mass affluent," people who have at least $100,000 of investable assets. "I think we're at the right place at the right time," he said.

Pending changes in bankruptcy laws that will make it more difficult for people to wipe the slate clean and later qualify for a commercial loan is likely to make intra-family lending even more popular, said John Mulligan, a real estate attorney in Minneapolis, who frequently facilitates housing-related loans between relatives.

Everyone agrees that being indebted to mom and dad or Uncle Moneybags is a situation that can be fraught with conflict.

John Boyd, a finance professor at the University of Minnesota's Carlson School of Management says intra-family lending can be as perilous as dating someone in the office. He said the best way to avoid problems is to get everything in writing and carefully and thoughtfully discuss the situation with other family members who might have a vested interest. That includes consulting with your spouse, other children and even your financial planner to find out more about the implications. Siblings who might feel entitled to the same benefits aren't the only ones to worry about. When Kris Wilson sold a south Minneapolis duplex to her stepdaughter several years ago, she financed the downpayment and held a contract for deed for a couple years while her stepdaughter finished nursing school. Then, the Internal Revenue Service came calling and did an audit. Wilson said they were probably checking to see if she was trying to escape paying capital gains tax on the sale of the investment property or if she had failed to pay a required gift tax. (Right now, the IRS annual gift limit is $22,000 per parent.)

Fortunately, Wilson hired an attorney to draw up an agreement and had an appraisal that was proof she sold the property for fair market value. At the time, mortgage interest rates were at about 8 percent - the same rate Wilson offered her stepdaughter 1/3 ilson, a mortgage lender for Summit Mortgage in Bloomington, said such intra-family loans were much more popular when interest rates were in the double digits, but are "not uncommon" today, particularly with buyers who need help to make a downpayment and to finance a second mortgage. She advises clients to hire an attorney to draw up paperwork and advise them about potential pitfalls. Weers, the Rosemount homeowner who borrowed nearly $200,000 from his father-in-law, searched the Internet for advice and found CircleLending, which was founded five years ago in Boston.

"We said, `Okay, if we do this we want to make it legal; we want him to have the same rights as a bank would over the property.'-"

Asheesh Advani, who worked for the World Bank in Washington, D.C., and had seen lots of inter-family lending in developing countries where commercial lenders are difficult to come by, said those transactions were mostly word-of-mouth deals with unusually high default rates. In large part, that's because the borrower and seller often failed to create structured payment arrangements that would keep the borrower disciplined. Following repayment schedules caused the default rate to drop by half, he said. "Once you fall behind you fall into a hole that's difficult to climb out of," he said. "We impose a discipline that keeps people on track." Advani said that for $599 the company will create a promissory note, mortgage and record that mortgage with the appropriate governmental office. The company does all the payment processing including direct deposit, a constantly updated amortization schedule and annual tax statements.

A growing number of Advani's clients are borrowers with adjustable rate mortgages who see the potential for rates to rise and want to lock in a lower rate with a loan from a relative. Lenders too are looking for safety in their investments. "There is some skepticism about annuities," Advani said. "People are searching for ways of earning 5 percent on their money and they're seeing intra-family mortgages as a way to do that."

Helena Semerjian of Lunenburg, Mass., said she felt that lending her daughter money to buy a $225,000 house was a better risk than the stock market. Semerjian said previous loans have gone unpaid, so she refused to make the loan without a rigid payment schedule and a legal agreement up front. They worked with CircleLending to draft an agreement and set up a payment schedule. Over the life of the loan she expects to earn more $50,000 in interest not including the interest she earns on the payments, which are deposited directly into a savings account. "The stock market is getting me nervous," she said. "So I said, `Let's take over the mortgage and exploit our daughter.'-"

Do not rely on verbal agreements. Make sure that all terms of the deal are clearly articulated in an agreement that is signed by the borrower (only the mortgage needs to be notarized). "Understand that the human memory is unreliable over long periods of time," attorney John Mulligan said.

3. Change

Over time, a borrower's circumstances are likely to change, so consider what will happen if that person gets divorced, has tax problems or runs into financial trouble. 4. Time

If your borrower falls behind on the payments and you get lazy about collecting the debt, be aware that most states have statute of limitation provisions that could legally eliminate a binding contract. 5. People A loan made to a family member today might be a loan to someone else tomorrow if a trustee, conservator, new spouse or heirs come into the picture. "When you change the cast of characters you can change the outcome," Mulligan said. "That friendly deal you made might turn unfriendly in the future if the people involved are no longer there." 6. Taxes

People tend to overlook tax implications when making loans and gifts, but it's very important to consider because gifts of any sort can become taxable events. "People should get advice about what their tax consequences might be and how that might integrate with estate planning," Mulligan said.

Attorney's files produce cautionary tales

These examples from the files of real estate attorney John Mulligan illustrate the subtleties - and complexities - of making loans to a family member.

One case involves a man who lent his brother and sister-in-law money to buy a house with no documentation. A couple of years later, the borrowers divorced, and the wife got the house. The court allocated this particular debt to the wife, who soon sold the house and moved out of state. Because the documentation was inadequate, no provision was made to automatically pay the brother/lender out of the proceeds, and he got nothing. The case went to court.

Another involves a man who bought property from his father with the understanding that when the father died the balance of the loan on the property would be forgiven and title to the property would be conveyed to the son. The father gave a deed to the son to hold and record upon his death, but after he died the son discovered that irregularities in the deed document prevented it from being recorded at the courthouse. The other heirs sought to establish that the property remained in the father's estate to be shared among them. This case went to trial.

SAVE TIME ON CHORES IN GARDEN.(Living)

Aching muscles and sore backs are as common in gardening season as slugs and mosquitoes. Do you really want to work that hard in the garden? I didn't think so. The body revolts when we feel obligated to spend most of a day (or weekend) attempting to catch up with planting, weeding, maintenance and projects. Good planning and a sharp edge on garden tools can help ease pain and suffering. Save you some time for other pursuits, too. Here are some helpful tips:

* Mulch rules. Spread it under shrubs, around ornamentals and vegetables. Layer it deeply. Worship the stuff. The payoff is less watering, fewer weeds and happier plants.

* Set aside a few minutes in the early mornings or evenings to search for and destroy weeds. Fewer weeds translates to fewer weed seeds, which means TSW (time spent weeding) will be dramatically reduced.

* Drip systems save time and water. Dragging hoses around is especially time consuming. Some enjoy hand-watering, but if you'd rather play nine holes, get drip irrigation.

* Garden during TV commercials. Let's say you don't want to miss the ball game or a movie on Lifetime Channel. Commercial blocks run three to four minutes or longer, plenty of time to deadhead a rose or move the hose.

* On weekends, break up gardening with generous rest periods. Take a trip to the nursery, watch TV, get on the Internet, grab a snack, walk the dog.

* Take advantage of weekday mornings and evenings to free up weekends. It's light enough to work outdoors until 9 p.m. If it doesn't get done, there's always tomorrow.

A slam-dunk for videoconferencing: ESPN taps Wire One system for the net's NBA-draft coverage. (Technology).

Baseball may be America's favorite pastime, but it certainly isn't America's favorite professional-sports draft, ranking a distant third to both football and basketball. The NFL and NBA drafts have become events worthy of wall-to-wall TV coverage, and that coverage lends itself to the use of innovative tools to enrich the telecast.

For the recent NBA draft, ESPN used Wire One's Glowpoint videoconferencing service and Polycorn's ViewStation FX equipment to enable ESPN's talent in Bristol, Conn., to talk with and see NBA team personnel at the 14 teams' draft headquarters across the country. The system, previously used for NFL drafts, allowing ESPN analysts and experts to ask NAB executives the one question asked again and again on draft day: "What were you thinking?"

According to Dan Steir, ESPN coordinating producer, remote production, cost saving is one of the biggest benefits of the system, but the gain in the quality of videoconferencing technology has also driven its use. "It's literally just a phone call, but the lesser quality is of minor consequence to viewers," he says, "and that should always be the main concern."

Glowpoint works as a service provider, hammering out the details between the long-distance-access providers and the last-mile providers to close the loop between ESPN's Bristol headquarters and the 14 arenas. The ViewStation FX camera system has a maximum bandwidth of 2 Mb/s and a 65-degree field of view with pan, tilt and zoom functionality.

Blair DeSio, senior program manager for Glowpoint, says the advantage the technology offers vs. something like ISDN is that it allows ESPN to react quickly without having to wait for connectivity. "ISDN connection times can be cumbersome and cause problems in a broadcast environment. With this system, you pick up the phone, and you're connected."

To connect to the teams' draft headquarters, according to Steir, ESPN accesses an Internet site that gives almost instantaneous access to the remote locations. Once Bristol is connected, it's basically a matter of getting the team personnel in front of the camera.

The 14 locations are tied into six circuits at ESPN headquarters, which bring the video into the ESPN plant. Two of the circuits are for redundancy, and the network connecting the 14 sites also has redundancy.

"If we have any problems with the last-mile connection, we can switch over to the other circuits," says DeSio. "We discovered a potential risk and are doing what we can to make sure it goes away."

He credits equipment improvements with raising the video quality to "business quality" over the past couple of years. Although it's short of broadcast quality, ESPN still sees it as good enough to broadcast. "When we did the NFL draft, there was a slight noticeable difference when the videoconference material was side by side with the broadcast material, but it was nothing that would prevent it from being broadcast quality."

Cost benefits extend beyond eliminating satellite costs, which, for an event like an NBA draft, could require five hours of satellite time. And cutting down on the number of feeds that need to be dealt with in the Bristol satellite receiving area eases the burden on that staff. There are also technology and personnel cost savings.
